Significant Appellate Cases

State v. Arnold, 133 Or App 647, 893 P2d 1050 (1995): held, Childrens Services Division case worker's testimony regarding victim's (who had recanted) earlier statements was not admissible as substantive evidence.  

State v. Swee, 51 Or App 249, 624 P2d 1108 (1981): held, the jury instruction concerning defendant's statements is re-quired whenever requested by the defense and supported by some evidence in the case at trial. 
  
State v. Spada, 286 Or 305, 594 P2d 815,(1979):  Oregon Supreme Court ruling concerning the availability through discovery of repair and maintenance records of radar devices in speeding cases.  Discussion of larger issues concerning constitutional analysis and discovery process.
